Davis Polk advised the representative of the several underwriters in connection with the $258 million offering of 39,696,320 shares of FuelCell Energy, Inc.’s common stock, which includes 14,696,320 shares sold by selling stockholders and 5,177,781 shares from the full exercise of the underwriters’ option to purchase additional shares from the company. The shares of common stock are listed on the Nasdaq Global Market under the symbol “FCEL.”
