We achieved a favorable pre-litigation resolution of claims over losses from crippling ransomware incidents

In a rare civil dispute arising from back-to-back ransomware incidents, Davis Polk was able to achieve a favorable pre-litigation resolution for our client, a consulting firm that provides incident response and forensic services to victims of cyber incidents. One such victim, which had experienced back-to-back ransomware attacks that crippled its operations, claimed that the services provided by Davis Polk’s client had been negligent, grossly negligent, and/or in breach of contract, and threatened suit to recover its losses from the incidents. 

By analyzing the tactics, techniques, and procedures of the attackers, and by developing evidence about the attack vectors at issue, Davis Polk was able to effectively rebut the allegations against its client, drive the matter toward voluntary mediation, and achieve a favorable resolution prior to a threatened filing date.
