Successful elimination of major competitor and revival of patent for TEK Global
Davis Polk represented TEK Global in long-running competitor case patent litigation with competitor, SSI over patented tire repair technology. TEK obtained a patent over a portable tire-repair kit in 2010 and sued, using different counsel.
Following a loss for TEK, as new counsel, Mr. Ramani revived a patent on appeal, vacated the injunction, and invalidated the counterclaim patent. He successfully fended off a last-ditch IPR in 2016, and then persuaded the jury in March 2017 that TEK deserved nearly all of its claimed damages. On March 17, 2017, Mr. Ramani successfully obtained a $2.8 million jury verdict for TEK Global.
Post-trial, the court granted TEK a permanent injunction, eliminating a major competitor from the market. The matter resolved with TEK obtaining nearly the entire verdict amount in a one-time settlement payment.
