Trial victory in patent infringement case for Magnolia Medical Technologies
We served as lead trial counsel for Magnolia Medical in an action against its sole competitor
Davis Polk secured a trial victory for plaintiff Magnolia Medical Technologies, Inc. in patent litigation in the District of Delaware against Magnolia’s sole competitor in the field of Initial Specimen Diversion Devices, Kurin, Inc. Magnolia Medical hired Davis Polk as trial counsel in the run-up to summary judgment on the two groundbreaking Magnolia Medical patents at issue. In a bifurcated trial, the Davis Polk team secured a verdict of infringement in the first phase and a verdict of damages and no invalidity in the second phase. The damages award represents a 17.7% royalty and the per-unit rate is available to be applied to additional infringing sales, which could increase the jury’s $2.1 million award several times over. The team will be moving for a permanent injunction promptly.
