Davis Polk partner and IP Litigation practice head Ashok Ramani was quoted in Law360 discussing Brumfield v. IBG, which could be taken up by the Supreme Court.  

Ashok noted that the case has a question of patent eligibility that’s been overshadowed by the foreign damages question, and he’s hopeful the Supreme Court could take up eligibility after years of rejecting such petitions.

“The tie gives it the possibility that maybe it will be accepted for other reasons, and so maybe then they’ll choose to address the question,” Ashok said.
