Davis Polk victory for Comcast in patent litigation highlighted in AmLaw “Litigator of the Week” column
The Davis Polk trial team that secured a ruling of no infringement on behalf of Comcast in patent litigation brought against the company by WhereverTV received runner-up honors in AmLaw Litigation Daily’s “Litigator of the Week” column. The team was led by partners Ashok Ramani and David Lisson, and included associates Serge A. Voronov, Kathryn Bi, Alena Farber, Micayla Hardisty and Elaine M. Andersen.
WhereverTV sued Comcast in 2018 for patent infringement related to the integration of Netflix and other over-the-top apps onto Comcast’s X1 platform. Comcast denied infringement, explaining that WhereverTV’s patent (Global Interactive Program Guide Application and Device) covered an interactive program guide feature that Comcast never used. WhereverTV, which was funded by Longford Capital, asked for $177 million.
On April 26, 2023, after a one-week jury trial and minutes before closing arguments were to commence, Judge William Jung of the U.S. District Court for the Middle District of Florida granted judgment as a matter of law of no infringement for Comcast.
