Davis Polk partner Pritesh Shah and counsel Matthew Bacal were recently quoted in Bloomberg Law on the increasing importance of data privacy and cybersecurity to avoid potential liability after a merger or acquisition. Pri noted that risk related to privacy and cybersecurity in M&A is only set to increase as additional state privacy statutes are passed across the United States. Matthew described how increased focus on data security by buyers has translated into sellers becoming more aware of their strengths and shortcomings.
