On August 19, 2021, co-head of Davis Polk’s Restructuring practice Damian Schaible will be among the speakers at the American Bankruptcy Institute’s Midwest Regional Bankruptcy seminar. Damian will speak on the “Commercial Session: Out-of-the-Ordinary Out-of-Court Restructuring Issues” panel. Topics discussed will include corporate finance transactions such as tender offers or exchange offers, convertible debt, PPP funding challenges and impacts, managing confidentiality/NDA issues, dealing with ad hoc committees and crossover committees, restructuring support agreements/death-trap provisions and strategies for garnering creditors’ support for a restructuring when no formal or informal committee structure is present for creditors.
