Davis Polk partners Donald Bernstein and Timothy Graulich will be among the speakers at the 18th Annual International Insolvency Institute Conference. Bernstein will moderate the “Will It Be Different: Are We Prepared for the Next Financial Crisis?” panel. Topics discussed will include:

  • Regulations and legislatures put in place worldwide to help resolve systemically important financial institutions (SIFIs) without disruption
  • What are the challenges to implementing orderly resolution utilizing these tools and can they be overcome?
  • Progress of implementing the new tools in various jurisdictions are the world, including the roles of resolution planning, total loss absorbing capacity, stays of financial contract close-outs

Graulich will moderate the “Mock Forum Shopping Exercise.” The session will give a look into the boardroom with a mock venue selection exercise in which the III audience will be an insolvent company’s board of directors and choose between competing venues for a cross-border reorganization.
