On April 24 – 25, 2025, Davis Polk partner and White Collar Defense and Investigations practice chair Neil MacBride and partner and National Security practice head Paul Marquardt will be among the speakers at the American Conference Institute and Canadian Institute’s National Committee on Foreign Investment in the United States (CFIUS) Conference. 

Neil will speak on the “Unpacking the America First Investment Policy and Emerging Trends in CFIUS” panel. Panelists will discuss the National Security Presidential Memorandum that was issued in March to promote foreign investment while protecting domestic security interests and will look at how investment policy guidance is advancing under the new administration.

Paul will moderate the “Spotlight on Private Equity and Venture Capital Investment Fund Structures That Trigger a CFIUS Review” panel. Topics discussed will include the role and responsibility of a PE manager, how to structure investment funds, what is and is not considered a covered investment, how to determine when a fund structure investment is at risk of becoming the subject of heightened scrutiny and how to calculate risk and potential exposure regarding the bigger picture impact on the transaction.
