Davis Polk partner and IP & Commercial Transactions practice head Frank Azzopardi and partner David Bauer authored “Companies using Chips Act money should mitigate march-in risks” in Bloomberg Law. In the article, they discuss the importance of assessing, managing and mitigating march-in rights risk before accepting federal funding from the 2022 Chips Act.

Frank and David explain that although such funding may seem attractive, it comes with certain conditions, including the U.S. government’s rights to “march in” and compel granting of licenses of federally funded intellectual property to third parties if certain criteria are met.
